Proceeding initiated by the administrator with the will annexed of the estate of Helen Michaels, deceased, for instructions
as to whether certain assets should be treated as owned individually by the deceased at the time of her death or whether they
were then owned by her in joint tenancy with one or more other persons. Included in these assets was Savings Account #1395
in the State Bank of Newburg, the passbook to which was registered in the name of Helen Michaels or Harry Michaels. Immediately
below the written names was stamped these words, "A joint and several account payable to either or the survivor." At the time
of death of Helen Michaels on September 22, 1961, there was the sum of $4,110.50 on deposit in this account. Harry Michaels
is the son of Helen Michaels and survived her. A hearing was held on the petition for instructions of the administrator with the will annexed. By memorandum decision the
county court determined that it was not the intent of Helen Michaels to create a joint ownership in this bank account with
a right of survivorship in Harry Michaels; Harry Michaels' name had been included on the bank-account passbook for the convenience
of Helen Michaels; and the account was solely owned by her at the time of her death. An order was entered under date of July
6, 1964, that this savings account "remain and be considered as personal property individually owned by the deceased at the
time of her death." Harry Michaels has appealed from this order. Further facts will be stated in the opinion.
